Course Objectives

The student deepens the fundamental institutions of Private law, with particular attention to the matter of the human rights, inheritance, obligations and contracts, civil liability, ICT legal issues.
The aim of the Course is to give to students, in a gradual and systematic manner, the necessary familiarity with the language and the logic of Private law and, therefore, to make them acquire a solid method of legal analysis of private relationship.

The aim of the Course is to give to students, in a gradual and systematic manner, the necessary familiarity with the language and the logic of Private law and, therefore, to make them acquire a solid method of legal analysis of private relationship.
The attention will be focused on the skills to give a complete and accurate picture of the
topics and to read the particular cases in the light of general principles as well as on the capacity to describe the cases explained in text and discussed during the lessons.

Assessment Methods

Oral examination.
The exam will be aimed at verifying the understanding of the legal institutions covered by the program, the conscious use of legal concepts and the ability to critically analyze the impact of the law in social relations. The assessment of the interview will be carried out taking into consideration: the knowledge of institutional profiles and the jurisprudential guidelines; the ability to make connections between the different parts of the program; the ability to develop critical arguments; the exposure articulation; the accuracy of the exposure.

Michele Sesta, Manuale di Diritto di Famiglia, Cedam, 2019 (referring to the specific content of the course).
The Italian civil code in an updated version must be used both in classes and during the preparation of the exam (as suggestion, Perlingieri - Angelone (edited by), Codice Civile con Costituzione, Trattati UE e FUE, Leggi complementari e Codici di settore, ESI, 2021).

The first part of the course covers the legal concept of natural person. The following issues will be analyzed: fundamental rights, the notion of legal capacity and ability to act, key legal instruments for individual rights.
The second part concerns the legal status of minors with respect to the family, filiation, adoption, and maintenance obligations.
