Juridical Dualism in Medieval Southern Italy: Studies on the Codex Diplomaticus Cavensis

abstract:
The Codex diplomaticus Cavensis, a medieval documentary collection, represents an
important historical source for Southern Italy during the High Medieval period. Along
with a wide range of different information, from historical facts to social behaviour, some
of the acts of the collection present a series of juridical peculiarities, which led to
investigate the relationship between Lombards and Romans from a new point of view.
The knowledge of the Lombard history, law and customs is essential for this study,
which consists of the analysis of documents, in which the Lombard and the Roman law
coexist. The aim is to understand the possible rational reasons for these interpenetrations,
using the information of each act and the references given by the Lombard and Roman
laws. The understanding of these factors allows to focus other important social
implications.
