Course Objectives

Educational objectives:
The course gives to the student the tools to know and solve the legal
issues posed by the development and the diffusion of artificial
intelligence systems and robotics based on algorithmic bases.

Expected learning outcomes:
Knowledge and understanding of the current civil liability system (Italian
and European) with particular regard to the special sector regulation, the
national and European jurisprudence, the provisions of the Authorities,
the ethical principles, the self-regulation codes and, more generally, to
the soft law techniques that contribute to the regulation of artificial
intelligence systems.
- Ability to correctly frame specific concrete problems from a legal point
of view;
- Ability to argue the legal solution of practical issues of normal
complexity

Teaching Methods

The course will be conducted as a seminar, with the format to be agreed upon with Professor Gambini, who can be contacted at the following email address: m.gambini@unich.it

Assessment Methods

Final oral exam aimed to verifying the knowledge of the treated
institutions; an adequate capacity for exposure and the necessary
mastery of the method and the language of Private law; the ability to
correctly frame specific concrete problems from a legal point of view and
to argue the legal solution of practical issues of normal complexity.
They can be expected partial tests (oral or written), to be carried out in
the classroom, even in a collective way, reserved for attending students,
whose purpose is to verify the understanding of the topics covered in
class and the practical application of the arguments studied at a
theoretical level.

Contents

The course examines the legal issues posed by the development of
Artificial Intelligence (AI) and robotics systems and, in particular,
determined by the need to guarantee effective and equitable protection
to victims of the damage that may arise, without compromising or
delaying the development of the digital market. It analyze also the
controls and the duties of care (IA Act) placed on the actors of the algorithmic data processing, in order
to reduce the risks and prevent the damage connected with them.
Moreover, the course addresses the open question of civil liability for AI,
which requires verifying whether the current civil liability system (Italian
and European) is able to cope with the new figures of damage to
algorithmic treatments or if there is the need to develop regulatory
instruments, including sectoral ones, that are different and more efficient
than those currently note. From this, it emerges the need of an uniform
regulation at the level of the European Union, which requires the exam of
recent dir. UE/2024/2853 and European resolutions and proposals (regulations and directives), in
terms of ethics, responsibility and controls for AI.
