Course Objectives

Educational objectives: The fundamental purpose of the course is to provide students with both a basic knowledge of the fundamental institutions of public / constitutional law, and, given the placement of the discipline in a degree course in Sociology and Criminology, an in-depth toolkit on dialectical relationship between public law and social and economic change. To this end, the study of the most important themes for the sociological and criminological area will also be deepened, also with some applications and laboratories, to allow students to acquire not only theoretical skills on the effective application of the institutes and principles studied. More specifically, with reference to Dublin Descriptors, the course aims to the following objectives. Knowledge and understanding: - of the foundations of the general theory of law; - of the sources of law in a multilevel perspective; - of the main institutes of public and constitutional law and in particular of the forms of state and government, and in particular of the Italian one; - of the freedom rights ; - of “new” rights and particularly about the Privacy and data protection rights, also in their historical evolution. Ability to apply knowledge and understanding: - In recognition of the various institutions of public and constitutional law; - in the solution of possible conflicts between sources of law; - in the critical reading of the action of the public authorities and of the related deeds; - in the fruition and organization of “new” rights and particularly about the Privacy and data protection rights. Autonomy of judgment: - with regard to the action of the public authorities with respect to the constitutional dictates in a multilevel perspective - in particular with regard to legislative and regulatory acts issued in particular branches; - in particular with regard to legislative and regulatory acts issued in the context of Privacy and data protection rights. Communication skills: - Acquisition of an adequate technical-legal language in the field of public law. Learning ability: - Ability to find and consult autonomously the legal sources, also in a multilevel perspective, in the sectors of interest; - Ability to find and consult normative and jurisprudential comments of interest.

Learning assessment procedures: Possible optional intermediate written test for attending students. Oral examination, possibly divided into partial examinations.

Contents: MODULE 1 - Institutional part (6 credits) MODULE 2 - Privacy and Personal Data Protection rights"(3 cfu) MODULE 1 - The course aims to provide the basic knowledge concerning the legal configuration of the State, the system of regulatory sources, the constitutional and administrative organization of the State and public bodies and the regulatory function of the State, with particular attention to the role of interactions between constitutional order and social and economic change. The fundamental objective is to provide the necessary skills to operate in an increasingly dynamic institutional context characterized by a balanced public budget, by liberalization of social relations and economic spaces, the globalization of law and the modernization of public powers. MODULE 2 - A second part of the course will be specifically dedicated to the knowledge of the "new rights " category, and particularly to the Privacy right and to the data protection right. It will be especially developed the role of the Data protection Officer in the enforcement of “Privacy” right, as an application laboratory to better understand the material operating mechanisms of the public law institutions and the theoretical notions learned in the first module in relation to one of the new sectors of greater importance and transformation in the relationship between citizen and public power.
