Syllabus

Course Objectives

In line with the objectives of the degree course - including that of training a Master's degree student in Psychology who has the knowledge and skills to operate in a legal context and, in particular, in the civil trial scenario - the Module aims to acquire
- Knowledge and understanding of the fundamental principles and rules of the trial, with particular reference to the subjects (judge, parties, auxiliaries and the prosecutor), evidentiary instruction and court-appointed expert witnesses;
- Knowledge and understanding of the fundamental rules of the trial as applied to the ordinary rite of cognition and to proceedings concerning persons, children and families;
- Ability to express argumentative content for the correct handling and solution of controversial cases, applying theoretical knowledge to real forensic cases;
- Communication skills necessary for interlocuting with experts in the field of civil litigation.

Lectures, tutorials, discussion of case law.

Assessment Methods

Oral examination aimed at testing knowledge of the individual institutes and the ability to reason in order to organise the knowledge acquired into a system. The assessment learning involves awarding of a final mark expressed in thirtieths. The final mark is derived from the overall assessment of the oral test and results from verification of the level of achievement of the learning outcomes set. For purposes of awarding the mark for the oral test, the questions are weighted equally.
It is also possible to take intermediate examinations (exemptions) reserved for attending students (at least 75% of the lectures), who will be able to take the examination on a syllabus agreed with the lecturer, which will focus essentially on the course content according to the indications provided by the lecturer. The mid-term examination will be awarded a mark expressed in thirtieths, in accordance with the above criteria. This mark will be averaged with final examination mark.

During the course the student will be provided with study material relating to the topics covered, in particular slides and summary summaries.

Contents

The course focuses on the study of the general principles of civil procedural law and the specific institutions that define the civil trial scenario in which the future graduate will operate.
These are the course contents in detail
- Law and process; sources of civil procedural law;
- Civil process and the Constitution;
- The civil judicial protection of rights and its various forms and articulations;
- The subjects of the trial: the judge; the parties; the judge's assistants; the public prosecutor;
- The burden of proof; Probative instruction; Court-appointed expert witnesses;
- Fundamental principles and rules of the ordinary rite of cognition and proceedings in matters of persons, minors and families.
