Syllabus

Course Objectives

In line with the objectives of the Course, the student will acquire the following:
KNOWLEDGE - Knowledge of the general system of Italian criminal proceedings, set within the framework of constitutional principles and regulated by the current Code of Criminal Procedure. Through specific in-depth studies, the student will acquire specific knowledge of the institutes most relevant to the operator's training in legal or criminological psychology. In this sense, specific attention will be paid to the aspects of penitentiary law.
SKILLS – Ability to apply theoretical knowledge to real cases and to identify solutions to the practical problems that most interest the operator in legal psychology. Critical thinking skills. Acquisition of the communication skills necessary for the relationship with experts from other sectors through the refinement of knowledge, understanding and practice of the specific language of criminal procedural matters.

Teaching Methods

27 hours of frontal lessons and exercises, with the participation of magistrates, lawyers, or other operators.

Assessment Methods

Oral test aimed on the topics of the course.
Evaluation criteria for the tests will be: 1) Knowledge of the contents; 2) Ability to synthesize, connect and orientate between the sources; 3) Knowledge, understanding and use of specific language.
The test will be evaluated with a score between 0 and 30 (with possible honours). The rating from 18 to 23 indicates a sufficient level, the rating from 23 to 28 indicates a good level, the rating from 28 to 30 indicates an excellent level, the "with honours" rating indicates particular analytical and critical reasoning skills of the students. course topics.

Texts

Given the frequent changes affecting the Criminal Procedure Law, the texts will be indicated before the start of the cycle of lessons, so as to guarantee students the most up-to-date training.
It is, however, essential to consult the Code of Criminal Procedure and the Law no. 354/1975, in any of the editions available on the market or on the internet.

Contents

The course aims to frame the structure and the functioning of criminal proceedings, and highlight the most useful aspects for the training of scholars and operators in psychological sciences.
The constitutional framework of the criminal trial - The fair trial - Models (inquisitorial and accusatory) - The phases of the criminal proceedings - The exploratory function of preliminary investigations - The trial scrutiny.
The assessment of the capacity of understanding and will, of the social dangerousness and of the procedural capacity during the investigations and in the trial: focus on the evidentiary incident and expert opinion (static and dynamic profiles) - The expert opinion on the personality and character of the accused: the prohibition in the proceedings and openings for the purposes of the execution of the sentence of conviction.
Profiles of penitentiary law: general information on the function of punishment - The scientific observation of the personality - The preparation of the treatment program - The evaluation of the convicted person in contexts outside the institution.
