Course Objectives


The course aims to contribute to the achievement of the educational objectives of the Course of study, providing a complete and up-to-date picture of the systemof private law. In this perspective, the main institutions of private law are examined, with particular attention to their function and to the analysis of the meaning of the legal provisions governing them. With regard to the planned results, at the end of the learning process the students will have to demonstrate:- Knowledge and understanding about the fundamental aspects of the institutions of private law studied, placing them in relation with the axiology of the Italian legal system.- Applying knowledge and understanding: students are able to use principles, categories and the contents of the Course to understand doctrinal issues or to elaborate pratical solutions regarding concrete legal cases.- Making judgements: students are able to demonstrate skill in the analysis of principles, categories and topics studied.- Communication skills: students are able to adequately communicate and clearly explain the contents of the Course and the results of the study, by using a proper legal language.- Learning skills: students must master the disciplinary, conceptual and operational tools in order to independently apply and update the acquired knowledge. Students are also able to link - using normative, jurisprudential and doctrinal sources - what they have learned in the context of other teachings of the Degree course.

Teaching Methods


The course consists of 96 hours of face-to-face teaching, structured into lectures, seminars, workshops, and practical exercises delivered in a blended format (in-person and synchronous online). The aim is to guide students in their learning process by providing structured analysis of case studies, examination of judicial decisions, and guided discussion of key concepts, while fostering active participation, critical thinking, and autonomy in organizing individual study.

Assessment Methods


Consistent with the learning objectives and the expected learning outcomes as well as with the teaching methods adopted, the exam consists, at the end of the lessons and seminars, in a final oral exam consisting of 3-5 questions aimed at verifying the ability of systematic framing, the property of language, the ability to link between institutions, the clarity of exposure regarding the program to be taken to the exam. The final grade goes from 1 to 30 with honours (cum laude), according to the following modalities: 1-17, insufficient; 18-21, sufficient; 22-24, fair; 25-27, good; 28-29, very good; 30-30 with honours (cum laude), excellent. Mock exams, self-assessment tests, and intermediate evaluations (written or oral), all optional and reserved for attending students, may also be offered.

The possession of an updated Civil code is an indispensable aid for the knowledge of the subject. We recommend the edition edited by: G. PERLINGIERI e M. ANGELONE, Codice civile con Costituzione, Trattati UE e FUE, Leggi complementari e Codici di settore, ESI, Napoli, ult. ed.
It is also recommended to consult the materials published on the FAD platform, in the section dedicated to the course.

Contents


The course is focused on the examination of the main private institutions, withparticular regard to the function of the same and to the analysis of the meaningthat the regulatory provisions governing them assume considering the overall system and the values that characterize it.In line with the educational objectives of the degree course, special emphasis is given to thethemes of obligations and contracts.
