Syllabus

Course Objectives


The course aims to provide the basic knowledge of the main institutes of Roman private law and to enable the acquisition of the historical-legal skills essential for the understanding of the forms and the substantial aspects of legal problems as outlined by their ancient historical foundations. At the end of the course the student will be able to proceed to the historical interpretation of legal issues independently and with an adequate critical method.
Knowledge and understanding: The course aims to a critical-reconstructive deepening, understanding and knowledge of the general outlines and institutes of the Roman legal experience, as well as of developments in the Roman tradition.
Applying knowledge and understanding: the course aims to encourage student’s critical reasoning and to provide them with the methodological tools to better understand how Roman legal tradition has influenced modern legal systems.
Making judgments: The teaching methodology aims to enable students to analyze the development of Roman law critically and independently.
Communication skills: the student must be able to explain, also to non-experts in the sector, the main institutes of Roman law and to use the technical terms of the discipline.
Learning skills: the course provides the student with notions and knowledge specific to the sector but also indications and suggestions to better understand and interpret the similarities/divergences with modern legal systems.

Course Prerequisites


Basic knowledge of Roman history (at high school level).
There are no propaedeutic constraints.

Teaching Methods


Frontal lectures. In addition, possible cycles of seminars and workshops on sources and bibliography.

Assessment Methods


Oral examination. The final grade (expressed in thirtieths) ranges from 1 to 30 cum laude, as follows: 1-17 insufficient; 18-21 sufficient; 22-24 fair; 25-27 good; 28-29 very good; 30-30 cum laude excellent.
The following evaluation criteria will be taken into account to assign the final grade: knowledge and understanding of the notions and principles of the matter (60%); appropriate use of the technical and legal vocabulary (10%); ability to analyze and evaluate relevant sources and acquisition of the study method (30%).

1. Paola Lambrini, Fondamenti del diritto europeo. Manuale istituzionale, Torino, Giappichelli, 2021 (p. 1-225);
2. Felice Mercogliano, Periodi e fonti del diritto romano. Appunti, Napoli, Jovene, 2022 (p. 1-80).
Alternatively other textbooks to be agreed with the Professor.

Contents


Roman law in Europe; Roman foundations of European law; Fundamental partitions and categories; The institutional system of private law (law of persons, property, succession, obligations, procedure). Roman private law: personae (persons and family), res (property and rights in rem, succession, obligations and contracts) and actiones (Roman civil procedure).
