Course Objectives


In order to contribute to achieving the educational objectives of the Degree Programme, this course aims to provide the specific professional profile it is designed to train with an organic and up-to-date overview of key areas of private law. These areas have undergone rapid evolution and significant transformation in recent years, driven both by legislative interventions (often implementing principles of European law) and by case-law developments.As for the expected learning outcomes, at the end of the learning process—which also involves cooperative and workshop-based activities—students should be able to understand and manage the transformations characterising contemporary legal practice, demonstrating the acquisition of knowledge and skills needed to resolve concrete cases and the legal issues they entail with autonomous critical analysis. They should also be able to draft clear, coherent, and well-reasoned legal texts, and to master the logical-argumentative techniques inherent in legal reasoning.

Course Prerequisites

Students must master the basics of Private law.

Teaching Methods


Lectures will be complemented by practical exercises designed to ensure active student participation, with the aim of developing applied skills on innovative, interdisciplinary topics. In particular, also through the formation of study groups, students will analyze cases drawn from national and European case law and engage in legal drafting activities (such as contracts or legal opinions), intended to stimulate argumentative debate and refine both oral presentation skills and technical legal writing abilities.

Assessment Methods

Consistent with the learning objectives and the expected learning outcomes as well as with the teaching methods adopted, the exam consists, at the end of the lessons and seminars, in a final oral exam consisting of 3-4 questions aimed at verifying the ability of systematic framing, the property of language, the ability to link between institutions, the clarity of exposure regarding the program to be taken to the exam. The final grade goes from 1 to 30 with honours (cum laude), according to the following modalities: 1-17, insufficient; 18-21, sufficient; 22-24, fair; 25-27, good; 28-29, very good; 30-30 with honours (cum laude), excellent. Intermediate exam can also be programmed (however it is not mandatory and is reserved only for attending students).

Texts


The following textbook is suggested for exam preparation:
• G. Perlingieri, L. Mezzasoma e M. Angelone (a cura di), Manuale di diritto dei consumi, Napoli, 2024.
It is also required to study the materials provided on the FAD platform in the course-specific section, which are available to both attending and non-attending students.

Contents


The core content of the course is divided into a general part - focusing on the study of the basics of EU private law and the integration process between national and EU law - and a special part. This deals with consumer law in the Italian-European system of sources, which is constantly evolving, also in order to adequately respond to the protection thrusts deriving from the changes imposed by the digital era. Particular attention is devoted to the examination of the consumer relationship and the discipline placed on consumer protection; the regulation of unfair commercial practices and misleading advertising; and the special regime of certain contracts concluded by consumers with entrepreneurs or freelancers. Producer liability and liability for environmental damage will also be addressed. The course, in line with the training objectives, will be conducted paying particular attention to application practice, following the analysis of the main regulatory sources and the study of the most relevant case law on the subject, both national and European.
