Course Objectives


Learning Objectives:

The course aims to deepen knowledge of the discipline of applicable private international law rules.



Expected learning outcomes:

At the end of the course, students will be able to identify the main issues arising from private international law relations and deal with them, identify the relevant rules and find in legal doctrine and case-law information useful for understanding them.

Students will thus be able to apply the theoretical knowledge acquired by correctly setting out the treatment of concrete cases and formulating sound arguments related to them.



Knowledge and understanding:

Students are expected to demonstrate to Students must demonstrate knowledge and understanding of the fundamental rules of private international law and be able to interpret and apply them.



Autonomous assessment capacity:

Students are expected to demonstrate that they are able to make appropriate connections between the rules of private international law and other applicable national, European Union and international rules.



Communication skills:

With regard to private international law, students should demonstrate their ability to:

- draw up dossiers and report on concrete cases;

- solve problems of concrete realisation;

- correctly set out the discussion on specific issues, and formulate appropriate arguments.




Course Prerequisites


Prerequisites:

In order to properly learn the subjects covered in the course, it is useful for students to have acquired knowledge of the basic issues relating to the Italian legal system and the relationship between international and European Union norms and domestic norms.




Teaching Methods


Teaching methods:

The course is structured in a theoretical part and a practical part divided as follows:

- classroom lectures on private international law and foreign sovereign debt;

- seminars, workshops and simulations of practical cases to be solved and techniques for the preparation and drafting of in-depth practical dossiers on the topics of private international law.




Assessment Methods


Assessment and examination methods:

Assessment of student learning will be an oral test.

The arguments reflect those dealt with during the teaching and included in the programme/syllabus.

The final oral test is the same for both attending and non-attending students.

Partial examinations: a partial examination is foreseen in order to facilitate the preparation of the final exam, reserved to the attending students.

The final mark is in thirtieth percentile.

Contents:

The course covers the topic of private international law, which needs to be applied when scenarios arise relating to legal relationships and situations that do not end in the horizon of a single country, but have elements of internationality, i.e. points of contact with the life of two or more states.

The course addresses the fundamental aspects of the rules of private international law that aim to solve four major problems: (1) jurisdiction; (2) applicable law; (3) the effectiveness of foreign decisions; (4) cooperation between authorities of different States.




Course Language


Teaching language:

Italian and English. Furthermore, in order to improve English proficiency, additional advanced seminars will be provided in English.
