Abstract:
The Author analyzes the discipline contained in art. 4 of the Workers' Statute, as reformed in 2015,
which allowed the use of information acquired in the context of controls, within the limits and conditions of
compliance with the rules on privacy. The author, in particular, supports the legitimacy of the legislation in the
light of the principles developed by the European Court of Human Rights, which requires national legislators to
adopt appropriate legislative rules to balance the organisational needs of businesses and the right to confidentiality
of employees.
